These Terms of Use (“Terms”) are an agreement between you and
DEMO School (“we”, “us”, “the Institution”) governing your use of the
NIFMAC Student Portal Android application (package com.codefixit.nifmstudentapp, “the App”)
and this website (together, “the Services”).
By logging in or otherwise using the Services you accept these Terms and our Privacy Policy. If you are under the age of majority, you may use the Services only with the consent and supervision of your parent or legal guardian, who accepts these Terms on your behalf. If you do not agree, do not use the Services.
1. Who may use the Services
- The App is a private portal for students currently enrolled with the Institution.
- There is no public registration. Accounts are created and issued by the Institution.
- Your right to use the App lasts only while your account is active with the Institution.
2. Your account and password
- You are responsible for everything done through your account.
- Keep your system ID and password confidential. Do not share, lend, sell or transfer your credentials.
- Change your password immediately, and inform the Institution, if you suspect it has been compromised.
- Do not attempt to access another person’s account, records, receipts or documents.
3. Permission to use the App
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the App on a device you own or control, solely to access your own academic information for your own educational purposes. All other rights are reserved.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent or abusive purpose;
- Copy, modify, decompile, reverse-engineer or create derivative works of the App, except to the extent this restriction is prohibited by law;
- Access the Services through automated means — bots, scrapers, crawlers or scripted requests — or interfere with, overload, probe or attempt to bypass any security, rate limit or authentication control;
- Upload malware, or any file that infringes another person’s rights;
- Impersonate any student, teacher, staff member or the Institution;
- Post abusive, harassing, defamatory, obscene or otherwise objectionable content in a support ticket or any other input field;
- Publish, resell or redistribute material obtained from the App — including question banks, e-library documents, notices, result cards or seat plans — outside the Institution;
- Photograph, screen-record or re-publish another student’s personal information.
5. Online examinations
Where the Institution runs online (MCQ) examinations through the App, you agree that:
- Each examination has a defined window, duration and number of permitted attempts, and your attempt is submitted automatically when the time expires;
- The examination must be taken by you alone, without assistance, unauthorised material or any other person, device or application;
- For integrity purposes the system records exam-session signals — including how many times you leave the exam screen or switch away from the App, and the timestamps of your attempt — as described in the Privacy Policy;
- Attempting to copy questions, share answers, use multiple accounts or manipulate the examination may result in the attempt being cancelled, a zero score, or disciplinary action under the Institution’s rules;
- The Institution’s decision on any examination irregularity, and on the official marks, is final.
Marks, grades and results shown in the App are those recorded by the Institution. A network failure, device fault or interruption during an attempt does not by itself entitle you to a re-examination; such cases are decided by the Institution on their merits.
6. Accuracy of academic and financial information
- Attendance, results, transcripts, seat plans, fee dues and receipts are shown for your convenience and may be updated, corrected or recalculated by the Institution at any time.
- Where the App and the Institution’s official records differ, the official records held by the Institution prevail.
- Fee amounts displayed are indicative of the Institution’s ledger at the time of viewing. A payment will normally appear only after it has been recorded by the accounts office.
- The App displays payment receipts for viewing only — it does not process payments. All payments must be made through the channels the Institution officially approves.
- If you believe an entry is wrong, raise it through the App’s support desk or with the office promptly; do not rely solely on the App for a deadline or a certificate.
7. Intellectual property
The App, the website, their design, software, text, graphics and logos, and all content published by the Institution — including question banks, e-library items, notices and result templates — are owned by the Institution or its licensors and are protected by copyright and other laws. They are provided for your personal study only. You may not reproduce, distribute, publicly display or commercially exploit them without our prior written permission.
8. Content you submit
You are responsible for the content of your support tickets and any file you attach. You confirm you have the right to submit it, and you grant the Institution permission to store, review and use it for the purpose of handling your request and maintaining its records. We may remove content that breaches these Terms.
9. Availability, updates and changes
- The Services are provided on an “as available” basis and may be interrupted for maintenance, upgrades, network problems or events beyond our control.
- We may add, change, suspend or withdraw features, and may require you to install an updated version of the App for it to keep working.
- The App requires an active internet connection; data charges from your mobile operator are yours.
10. Suspension and termination
We may suspend or terminate your access without notice if you breach these Terms, if your enrolment with the Institution ends or is suspended, or if we reasonably believe your account is being misused or poses a security risk. You may stop using the Services at any time by uninstalling the App; account deletion is described in the Privacy Policy. Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability and governing law — continue to apply.
11. Third-party services and links
The Services may link to websites, documents or applications operated by others. We do not control them, do not endorse them, and are not responsible for their content, terms or privacy practices. Your use of the App from a distribution platform such as Google Play is also subject to that platform’s own terms.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Services will be uninterrupted, timely, error-free or free of harmful components, or that any information shown will always be complete or current.
13. Limitation of liability
To the maximum extent permitted by law, the Institution and its staff will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, opportunity or academic advantage, arising out of or connected with your use of, or inability to use, the Services — including a missed deadline, an examination interrupted by a device or network fault, or reliance on information later corrected. Nothing in these Terms excludes any liability that cannot lawfully be excluded.
14. Indemnity
You agree to indemnify and hold harmless the Institution and its staff against any claim, loss or expense arising from your breach of these Terms, your misuse of the Services, or your infringement of another person’s rights.
15. Governing law and disputes
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law rules, and the courts of the People's Republic of Bangladesh have exclusive jurisdiction over any dispute. We ask that you first raise any complaint with us through the support desk so that we can try to resolve it informally. Nothing here limits the Institution’s internal academic and disciplinary procedures.
16. Changes to these Terms
We may revise these Terms from time to time. The current version is always published on this page with its “Last updated” date, and significant changes will be announced through the App’s notice board. By continuing to use the Services after a revision takes effect, you accept the revised Terms.
17. General
- If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms; we may assign them to a successor of the Institution.
- These Terms and the Privacy Policy are the entire agreement between you and us about the Services.
